Termination of the Contract of Employment by Reason of Illness/Incapacity

The contract of employment can be terminated in relation to illness/incapacity in two ways:

  • termination of misconduct in cases of abuse of sick leave
  • "frustration" of the contract in serious genuine cases of illness or injury
